The NBA legend Tells Court He ‘Wasn’t Afraid’ of the Racing Body in Legal Battle
The basketball icon, introducing himself formally in a federal courtroom on Friday, stated that his competitive side and status as a newcomer motivated his effort with 23XI Racing to confront Nascar over perceived violations of competition laws.
Financial Stakes and a Will to Win
Jordan shared financial and corporate details of his 23XI team, saying he invested $40 million of his personal wealth into the Nascar Cup series team co-founded with business partner Curtis Polk and longtime driver Denny Hamlin.
“It fell to someone to act,” Jordan stated in the Charlotte courtroom. “I was a new person, I wasn’t afraid. I felt I could challenge Nascar in its entirety. From my perspective, the sport required examination from a different view.”
The Core Dispute: Franchise System and Contract Pressure
At issue is the expiration of a 2016 agreement where Nascar granted each team a “charter”. This system mirrors other major leagues with separately owned franchises, such as the NBA’s Hornets or the Carolina Panthers. The agreement was due to end in 2024 when Nascar demanded teams renew their charters.
Jordan was on the witness stand for an hour and exited the courthouse to pandemonium, with onlookers and reporters vying for a view or a photo of the global icon.
Spearheading the Fight
23XI Racing is at the forefront of the push along with another racing team for Nascar to change a business model Jordan said is unlawful to keep two hands on the wheel.
For Jordan and and a fellow team representative, who testified before Jordan, are details from September 2024. She recounted a hectic and tense period where the sanctioning body told teams they had to sign a charter agreement extension. This agreement consists of 112 pages detailing pay for chartered teams and a guaranteed entry in Nascar-sponsored races.
A Refusal to Sign
Jordan explained that his team and its ally concluded their only feasible option was to decline to sign that extensive document and take the issue to court. All other teams signed the agreement.
Jordan and co-owner Denny Hamlin approached Nascar about possible changes or extension options. Nascar refused to engage, according to his testimony.
The Ultimate Motivation: Winning
But in the end, the resistance against what he saw as a unsustainable system was driven by the usual bottom line for Jordan: Winning.
“Denny convinced me adding a third car improved our chances to win,” he said, noting that he bought a third charter late in 2024 for $28 million despite the uncertainty. “So I took the plunge.”
Heather Gibbs’ Testimony
Heather Gibbs detailed her push for indefinite franchises, submitted in a formal letter to Nascar. She testified the pressure of the contract signing demand didn’t sit well.
According to her, Joe Gibbs first attempted to call and talk Nascar out of demanding signatures, but Nascar’s leader declined the request.
“Please don’t force this on us,” Heather Gibbs said Joe Gibbs told Nascar’s executives. She said France replied, “Whether I have 20 charters, that’s what I have. If I have 30, I have 30.”
